Terms of Service
These terms cover using the Twiggli app and website — booking a workshop, and running one. Please read section 2: Twiggli connects you with hosts, but the workshop itself is a contract between you and the host.
Draft — not yet reviewed by a lawyer.
This document was written as a clear, plain-language starting point, not as legal advice. Highlighted fields still need real values, and a German lawyer should review it before it goes live — particularly sections 2, 5, 6, 11 and 12.
1. Who we are
Twiggli is operated by [legal company name], [address], Germany. You can reach us at [email address]. Full company details are in our Impressum.
In these terms, "Twiggli", "we" and "us" mean that company. "You" means anyone using our app or website — whether you are booking a workshop or running one.
2. What Twiggli is
Twiggli is a marketplace. Hosts publish workshops and activities; participants find and book them. We provide the platform, the video feed, the booking flow and the payment handling.
We do not run the workshops. When you book, the contract for that workshop is between you and the host. The host decides what happens, where it happens, who is qualified to run it and what it costs. We are not a party to that contract, and we are not the host's employer, agent or partner.
We check hosts before they can publish, but we cannot guarantee the quality, safety or legality of any individual workshop. Use your judgement, and tell us if something goes wrong.
3. Your account
- You need an account to book or to host. You must be at least 18, or have a parent or guardian's consent and involvement.
- Give accurate details and keep them current. Bookings and refunds depend on us being able to reach you.
- Keep your login credentials to yourself. Tell us promptly if you think someone else has access to your account.
- One account per person. Don't create an account for someone else without their knowledge.
4. Booking a workshop
A listing is an invitation to book, not a binding offer. Your booking becomes binding when we confirm it — by email, in the app, or both. Until then, the host may still decline or the spot may go to someone else.
Check the listing before you book: the date, the meeting point, what is included, what you need to bring, and any age, fitness or equipment requirements. If the host has set participation conditions, they apply to your booking.
Turn up on time. Hosts are not obliged to hold a place for a late arrival, and a missed workshop is not automatically refundable — see section 6.
5. Prices and payment
Prices are shown in euros and include VAT where it applies. The price you see at checkout is the price you pay.
Payments are processed by [payment provider]. We do not store your full card details. Your payment provider's terms apply alongside ours.
Listing a workshop is free. When a paid booking completes, we deduct a service fee of [fee %] from the host's payout. Hosts are paid out [payout schedule, e.g. within 7 days of the workshop taking place].
Free workshops carry no fee for anyone. A host may still ask participants to cover materials directly, but that must be stated clearly in the listing.
6. Cancellations and refunds
If you cancel
You can cancel a booking in the app. What you get back depends on when you cancel:
- More than [X] hours before the start: full refund.
- Less than [X] hours before the start: [partial refund / no refund].
- No-show: no refund.
If the host cancels
You get a full refund, automatically, to your original payment method. If a host cancels repeatedly or at short notice, we may remove their listings.
If the workshop changes
If a host materially changes a workshop after you book — the date, the location, or what the session actually is — you may cancel for a full refund.
7. If you host a workshop
When you publish a workshop, you confirm that:
- You are legally allowed to run it, and you hold any licence, permit or qualification it requires.
- Your listing is accurate — including the price, the duration, the location, the group size and what participants need to bring.
- You have the right to use every video and photo you upload.
- You have appropriate insurance for the activity, and you are responsible for the safety of your session.
- You handle your own taxes. We are not your employer, and hosting income is yours to declare. If you host as a business, you must say so — consumer protection rules will then apply to your participants.
Show up to your own workshops. If you must cancel, do it as early as you can and tell your participants directly.
8. Videos and content you post
Your content stays yours. By posting it on Twiggli you give us a non-exclusive, worldwide, royalty-free licence to host, display, resize and distribute it for the purpose of running and promoting the platform. That licence ends when you delete the content, except where we must keep copies for legal reasons or in ordinary backups.
Only post what you have the right to post. If you film participants, get their agreement first. We remove content that infringes someone else's rights — write to [email address] to report something.
9. What you may not do
- Break the law, or use Twiggli to arrange something illegal or unsafe.
- Post content that is misleading, hateful, harassing, sexually explicit or violent.
- Take bookings or payments off-platform to avoid our fees.
- Post fake listings, fake reviews, or impersonate someone else.
- Scrape, reverse-engineer, overload or attempt to break our systems.
- Use anyone's personal data from a booking for anything other than running that workshop.
10. Availability of the service
We aim to keep Twiggli running, but we don't promise it will be available without interruption. We may change features, pause the service for maintenance, or discontinue parts of it. Where a change is significant and affects you, we will give reasonable notice.
11. Our liability
We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For ordinary negligence, we are liable only where we breach an obligation that is essential to the contract and that you can reasonably rely on us to meet — and then only for foreseeable, typical damage.
Beyond that, we are not liable. In particular, we are not liable for what happens at a workshop, since we do not run it — that is between you and the host. Nothing here limits rights you have under mandatory consumer law.
12. Right of withdrawal
Consumers in the EU normally have 14 days to withdraw from a contract made online. That right does not apply to leisure services booked for a specific date or period — which covers most workshops on Twiggli (§ 312g(2) no. 9 of the German Civil Code).
Our cancellation policy in section 6 applies instead, and it is often more generous. Where the withdrawal right does apply to something you buy from us, we will tell you at checkout and give you the standard withdrawal instructions.
13. Suspension and termination
You can close your account at any time. Bookings already made still stand — honour them or cancel them properly first.
We may suspend or close an account that breaks these terms, that puts other users at risk, or that we are legally required to act on. Where it is reasonable to do so, we will tell you why and give you a chance to respond.
14. Changes to these terms
We may update these terms. If a change materially affects you, we will notify you at least [30] days beforehand by email or in the app. If you don't accept the change, you can close your account before it takes effect. Continuing to use Twiggli after that date means you accept the new terms.
15. Governing law and disputes
German law applies. If you are a consumer, this does not deprive you of the protection of mandatory law in your country of residence.
We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we do not currently do so.
